Health information privacy, the Health Insurance Portability and Accountability Act (HIPAA), and the Health Information Technology for Economic and Clinical Health (HITECH) Act are matters Melissa Levine knows inside and out, and on which she focuses her practice.
She has worked on HIPAA and health privacy issues since 1998 and counsels on a range of related issues, including HIPAA implementation and compliance, development of privacy policies and procedures, HIPAA privacy assessments, breach incidents, and HIPAA structural issues.
Melissa's extensive knowledge of the health care system has been an enormous asset to her clients. She helps health care companies, device manufacturers, labs, providers, health plans, health information technology companies, and academic medical centers comply with the regulations that impact their products, services, and research. Along with her deep understanding of HIPAA, Melissa is also immersed in state privacy and breach notification laws, including advising clients on compliance with the California Consumer Privacy Act (CCPA). She also counsels on other federal privacy laws including the substance abuse laws (Part 2) and the Genetic Information Nondiscrimination Act (GINA). She regularly advises clients on uses and disclosures of data, data transfers, covered entity and business associate compliance, de-identification, fundraising, genetics privacy issues, and research. Melissa also advises companies and health care entities on compliance with the EU General Data Protection Regulation (GDPR).
As counsel in our Privacy and Cybersecurity group, Melissa also assists genomics research companies and manufacturers with their regulatory compliance and HIPAA. While in law school at Georgetown University Law Center, she was a first-line editor of the Tax Lawyer. She is a lifelong resident of the Washington, D.C. area.
